End-User License Agreement (EULA)

This End-User License Agreement ("EULA") is a legal agreement between you ("User") and Topics Chat Portugal, LDA ("Topics Chat", "we", "us"), governing your access to and use of the Topics Chat mobile application and related services (the "Platform" or "Services").
By downloading, installing, or using the Platform, you agree to be bound by this EULA, our Terms and Conditions and Privacy Policy, which together form the full binding contract (the "Agreement"). If you do not agree, you must not download, install or use the Platform.
1. License Grant
Subject to your compliance with this Agreement, Topics Chat grants you a personal, non-exclusive, non-transferable, revocable and limited license to install and use one copy of the Platform on a device you own or control.
All rights not expressly granted are reserved by Topics Chat.
2. User Conduct and Zero-Tolerance Policy
You agree not to upload, share, transmit or otherwise make available any content that is unlawful, abusive, harassing, defamatory, obscene, hateful, discriminatory, threatening, or otherwise objectionable.
Topics Chat applies a strict zero-tolerance policy against objectionable content and abusive conduct. Violation of this policy may result in immediate removal of content, suspension, or permanent termination of your account without notice.
3. Age Restrictions
The Platform is not available to persons under 13 years of age.
Certain features may require you to be of legal age in your jurisdiction.
4. Account and Security
You are responsible for maintaining the confidentiality and security of your account credentials.
You must immediately notify Topics Chat of any unauthorised access or suspected breach.
5. Intellectual Property
All intellectual property rights in the Platform remain the exclusive property of Topics Chat.
You may not copy, modify, distribute, decompile, reverse engineer or create derivative works of the Platform, except as permitted by law.
6. Content Responsibility
You are solely responsible for all content you upload or share through the Platform.
You must ensure you have all necessary rights to any content you provide.
7. Content Moderation and Safety
Public interactions (Topics Chat Rooms, Channels, etc.) are subject to automated keyword filters, AI-based detection, and human moderation to identify objectionable content.
Users may report objectionable content or abusive profiles at any time via the in-app 'Report' function.
Users may also block other users to prevent any further interaction.
All reports are reviewed within 24 hours, and offending content or users may be removed or banned.
Private chats are encrypted end-to-end and not actively monitored, but users can report abusive profiles, which will trigger an investigation and enforcement action.
8. Contacts Synchronisation
The Platform may request access to your device contacts exclusively to allow you to synchronise and connect with your own contacts who are also registered on Topics Chat.
This feature is optional and requires your explicit consent.
Contacts are processed solely for matching purposes and remain associated only with your account.
Topics Chat does not share, disclose, or sell your contacts to third parties.
You can revoke access to contacts at any time in your device settings.
9. No Emergency Services
The Platform does not provide access to emergency services (e.g., police, fire, ambulance). You must use traditional communication methods to contact emergency providers.
10. Updates and Availability
Topics Chat may modify, update, suspend, or discontinue the Platform or Services at any time without liability to you.
11. Disclaimer of Warranties
The Platform and Services are provided "as is" and "as available", without warranties of any kind, express or implied. Topics Chat does not warrant uninterrupted, error-free, or secure operation.
12. Limitation of Liability
To the maximum extent permitted by law, Topics Chat shall not be liable for any indirect, incidental, consequential, or punitive damages, including loss of data, profits or goodwill.
13. Termination
Topics Chat may suspend or terminate your access to the Platform immediately if you breach this Agreement or engage in objectionable or abusive conduct.
14. Governing Law and Jurisdiction
This Agreement is governed by Portuguese law. Any disputes shall be subject to the exclusive jurisdiction of the courts of Lisbon, unless otherwise required by consumer protection law.
15. Export Compliance
You may not use or otherwise export or re-export the Platform except as authorised by applicable law. In particular, you may not export or re-export the Platform into any embargoed countries or to anyone on applicable government restricted lists.
16. Consent to Use of Data
You agree that Topics Chat may collect and use technical data and related information—including but not limited to technical information about your device, system and application software, and peripherals—that is gathered periodically to facilitate the provision of software updates, product support, and other services to you (if any) related to the Platform.
17. Entire Agreement
This EULA, together with the Terms and Conditions and Privacy Policy, constitutes the entire agreement between you and Topics Chat regarding your use of the Platform.
